ADDITIONAL HIGH TECH COMMISSION AGREEMENT

between

FULMONT MUTUAL INSURANCE COMPANY

And                                                                                                                        , Agent of Fulmont Mutual Insurance Company 

            THIS AGREEMENT, dated this  ____ day of _____________, 2000 between Fulmont Mutual Insurance Company, organized under the Insurance Law of the State of New York, hereinafter called "Fulmont", and                            Agent for Fulmont, hereinafter called "Agent".      

NOW THEREFORE: "Fulmont" and "Agent" do hereby agree as follows:  

1.            WHEREAS, "Fulmont" will pay an additional commission in accordance with the High Tech Commission schedule approved by the Company.  This additional commission is calculated on the Agent’s paid premium.  To receive this commission the Agent must comply with the following terms and conditions in this agreement as well as any other written guidelines or materials published by Fulmont in connection with the Fulmont High Tech Commission program:  

a.       Minimum Premium Base–The Agent must meet the criteria established in the Fulmont guidelines for the High Tech Additional Commission program.  

b.       Commission – The additional commission will be reported on the regular monthly commission report and will be paid through ACH normally prior to the 10^th of each month. 

c.       ACH – The Agent agrees to receive commission and any other reimbursement from Fulmont by ACH transfer.   Furthermore, insured payments that are received by the Agent in cash and any other monies deposited in the Agents bank account on behalf of Fulmont will be sent via ACH transfer.    

d.       Loss Notice – The Agent will prepare loss notices using our electronic Loss notice form and send it to Fulmont’s Claims Department via e-mail. 

e.       No Money Endorsements – The Agent will prepare no money endorsements using the templates provided by Fulmont, sending a copy to Fulmont Underwriters via e-mail.   It will be the responsibility of the Agent to distribute the endorsements to the insured and mortgagee. 

f.         Rating Programs – The Agent will use all available Fulmont rating programs and send the applications to Fulmont Underwriters by e-mail.  The signature page can be scanned and mailed to Fulmont electronically, or we may make other arrangements with your Agency on this particular matter. 

g.       Photos and Other Underwriting material – The Agent will convert photos and other underwriting material to electronic file format and send them to Fulmont’s Underwriting Department via e-mail. Other underwriting material would normally include requests for quotes. 

h.       Reports – Effective as of the date of this agreement, Fulmont will no longer provide the Agent with hard copy reports.  The Agent agrees to access all agency reports on the Fulmont 24/7/365 agent website. 

i.          Inquiry - The Agent agrees to use all inquiry programs on our 24/7/365 Agency web site to check and/or verify policyholder information. 

j.         Renewal List – The Agent agrees to complete and return the renewal list to Fulmont’s Underwriting Department via E-mail. 

k.       Communication – The Agent agrees whenever possible to use the secure and private Conference rooms available on our 24/7/365 web to communicate with Fulmont employees. 

2.         The Agent agrees that if Fulmont determines that the Agent has not fully met the above terms and conditions and/or the established guidelines of this “High Tech Additional Commission”, then this agreement will become null and void. 

3.         Fulmont understands that there may be isolated incidents where the Agent cannot comply temporarily with the program requirements.  If these incidents should occur they should be reported immediately to Fulmont management.  Fulmont would normally agree to continue to pay the additional commission as long as the Agent complies within a reasonable time.
